COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, February 16, 2017 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at www.co.comal.tx.us for agenda postings.
Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.

2. Discuss and consider final plat approval of Vintage Oaks at the Vineyard, Unit 14, accept Construction Bond #SUR60001242 as surety for road construction and storm water drainage improvements, and grant variance request. (Pct. 1)

3. Discuss and consider approval of the Amendment to Plats of Vintage Oaks at the Vineyard, Unit 12, and Vintage Oaks at the Vineyard, Unit 14, combining Lot 1440 of Unit 12 and Lot 1577 of Unit 14, establishing Lot 1440R of Unit 12. (Pct. 1)

7. Discuss and consider approval of a street name, DAMERAU LANE, for a private road located approximately 1,000 feet southwest of the intersection of Moeller Ranch Rd. and Schoenthal Rd. (Pct. 2)

8. Discuss and consider approval of Interlocal Agreement by and between Comal County, Texas, and the City of New Braunfels for construction staging for the Downtown Sidewalk Improvement Project, and authorize County Judge to sign.

9. Discuss and consider approval of Tax Assessor-Collector’s Monthly Collection Report – January 2017.

10. Discuss and consider approval of refunds (over $2,500.00) of ad valorem tax overpayments or erroneous payments and authorize the Comal County Tax Assessor-Collector to remit refund payments.

11. CONSIDERATION OF BIDS RELATING TO THE SALE OF OBLIGATIONS DESIGNATED AS “COMAL COUNTY, TEXAS LIMITED TAX GENERAL OBLIGATION BONDS, SERIES 2017”, CONSIDERATION AND APPROVAL OF FINANCIAL ADVISOR’S RECOMMENDATION CONCERNING THIS MATTER; AND OTHER MATTERS IN CONNECTION THEREWITH.

12. CONSIDERATION AND APPROVAL OF AN ORDER BY THE COMMISSIONERS COURT OF COMAL COUNTY, TEXAS AUTHORIZING THE ISSUANCE OF “COMAL COUNTY, TEXAS LIMITED TAX GENERAL OBLIGATION BONDS, SERIES 2017”; LEVYING AN ANNUAL AD VALOREM TAX, WITHIN THE LIMITATIONS PRESCRIBED BY LAW, FOR THE PAYMENT OF THE BONDS; PRESCRIBING THE FORM, TERMS, CONDITIONS, AND RESOLVING OTHER MATTERS INCIDENT AND RELATED TO THE ISSUANCE, SALE, AND DELIVERY OF THE BONDS, INCLUDING THE APPROVAL AND DISTRIBUTION OF AN OFFICIAL STATEMENT PERTAINING THERETO; AUTHORIZING THE EXECUTION OF A PAYING AGENT/REGISTRAR AGREEMENT, AND AN OFFICIAL BID FORM; COMPLYING WITH THE LETTER OF REPRESENTATIONS ON FILE WITH THE DEPOSITORY TRUST COMPANY; AND PROVIDING AN EFFECTIVE DATE.

13. Discuss and consider approval of the Texas Historical Commission FY 2017 Certified Local Government Subgrant on behalf of the Comal County Historical Commission, and authorize County Judge to sign.

14. Discuss and consider approval of US Army Corp of Engineers Solicitation #W9126G-17-T-0049 for Increased Law Enforcement Services at Canyon Lake and authorize County Judge to sign.

15. Discuss and consider approval of Resolution 2017-06 Approving the Submission of Grant Application to the Office of the Governor, Criminal Justice Division for the funding of the Back-up Server for the Existing Watchguard In-car Video Server Project.

16. Discuss and consider approval of Texas Council on Family Violence High Risk Team Demonstration Project Grant Agreement and authorize Criminal District Attorney to sign.

17. Discuss and consider approval of Resolution 2017-04 Approving the Submission of Grant Application to the Office of the Governor, Criminal Justice Division for the funding of the Protective Order Victims Assistance Coordinator.

18. Discuss and consider approval of Resolution 2017-05 Approving the Submission of Grant Application to the Office of Governor, Criminal Justice Division for the funding of the Protective Order Prosecutor.

19. Discuss and consider approval of Resolution 2017-03 Supporting Legislation to Amend Texas Human Resources Code Section 152.0521 Adding the 22nd District Court Judge to the Comal County Juvenile Board.

20. Discuss and consider approval of Resolution 2017-08 Approving the Submission of Grant Application to the Office of the Governor, Criminal Justice Division for the funding of the Challenge Felony Drug Court.

21. Discuss and consider approval of Resolution 2017-07 Approving the Submission of Grant Application to the Office of the Governor, Criminal Justice Division for the funding of the Accountability Court.

22. Discuss and consider approval of Order # 390 granting Discretionary Exemption from Section 262.023 of the Texas Local Government Code for Tyler Technologies Software Maintenance & Support.

23. Discuss and consider approval to use the Records Archive Fund to procure Preservation of Historical Record Books for the County Clerk utilizing Texas Multiple Award Schedule Contract TXMAS-13-36010 and authorize Purchasing Director to execute all related documents.

24. Discuss and consider procurement of Video Surveillance for Justice of the Peace Precinct No. 3 utilizing the Justice Court Security Fund and authorize the Purchasing Director to execute all related documents.

25. Discuss and consider approval of a line-item transfer in Information Technology, FROM: Recurring Contracts, TO: Copier Lease & Maintenance to ensure adequate funds for annual lease contract.

26. Discuss and consider approval of a line-item transfer FROM: General Fund Contingency, TO: Department of Public Safety Copier Lease & Maintenance to cover the cost of the copier lease for 2017.

27. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
